The shooting happened January 2nd during a traffic stop.
When officers Joe Poffel and Wesley Biles tried to handcuff the passenger’s one of them, Thomas Estes, reached for Bile’s gun. Court documents show Estes fire once but missed.
That’s when Poffel pulled his gun and fired, hitting Estes.
Earlier this week the Muskogee County District Attorney's Office ruled the shooting was justified.
Estes underwent surgery in Tulsa and is now in jail for possession of a weapon after being convicted of a felony along with assault and battery of a police officer.
The car was found to be stolen but the driver Marvin Green, will not face charges. The DA says there is no proof Green know the vehicle was stolen.
