Strong arguments can be made on both sides of the drug testing employees debate.
WOKV Legal Expert Mark Rubin says state workers will have the constitution on their side. He says the constitutionality may stand stronger with state workers not having to submit to the test.
But, looking at it from the state's perspective, does an employer have the right to know what's going on with their employees to make sure they can do their jobs effectively? Because the employee could leave for a job where they won't be drug tested.
Rubin expects hundreds of thousands of dollars in legal fees will go into debating both sides.
