Jacksonville, FL —

The Florida Highway Patrol says a St. Johns County Sheriff's Deputy hit a man on SR 207 around 10:30pm Sunday.

The FHP says a 33 year-old off duty St. Johns County deputy struck and killed the man who had apparently walked right out into the roadway after having car trouble in the grass median.

44 year-old Daryl James Hayward of Elkton was struck and killed.

The Sheriff's Deputy is 33 year-old Michael Butler Jr. of St. Augustine.

Charges are pending.
