Fernandez hearing postponed

Jacksonville, FL —

Another week awaits before 13-year-old Cristian Fernandez will learn about the future of charges facing him.

He was due in court for a hearing today, but that has been postponed to October 15th.

The lawyers for Fernandez have asked Judge Mallory Cooper to throw out the first-degree murder charge facing him.  At issue is Florida sentencing laws which require a life in prison or death penalty sentence for anyone convicted of first-degree murder.  But the US Supreme Court ruled this summer that it is unconstitutional for juvenile offenders to receive a mandatory life sentence.
