More information continues to surface about the Windy Hills Elementary School teacher who is now charged with multiple capital felony counts of sexual battery on a child younger than 12.

WOKV's previous article (seen on left) detailed a 2009 investigation into teacher Christopher Bacca by the Department of Children and Families.

The investigation concluded that Bacca had numerous sleep overs with a young boy but no sexual activity took place.  It also included that Bacca knew the boy's family.

Now WOKV has obtained a report on an investigation into Bacca by the Professional Practices Commission which is part of Florida’s Department of Education.

The office oversees teacher certification for all of Duval County’s Public Schools.

The front page of the report is a letter to Bacca which states, “Upon completion of the initial inquiry, the Office of Professional Practices Services has determined that at this time further action by this office is not warranted.”

The report has statements from the child, the child's mother, and other past students of Bacca.

All of them complimented Bacca.

Marva McKinney, who was principal of Long Branch Elementary where Bacca first worked, said, “He is loving and kind and always remembered their birthdays and celebrated their successes.”

The mother of a former student said she knew Bacca through the school for two years and they became good friends.   The mother credits Bacca for improving her son’s grades.  “He is much more outgoing, and is much more confident in his abilities.”

The former student stated he was in Mr. Bacca’s class.  They became friends and started “going out and having fun.”  They went out to restaurants, movies, and he “stayed with Mr. Bacca on the weekends because his mom would be tired.”

The child “slept in the bed with Mr. Bacca, but stated Mr. Bacca would not do anything to make him feel uncomfortable.”

Finally, it states that the child “likes Mr. Bacca because he is the only father he has.”

There are also other compliments of Bacca made by five other past students of his.

The report says no sexual activity took place between him and the child according to an investigation by the Jacksonville Sex Crimes Unit.

The Department of Education did not decide to revoke his teaching certificate.

This week the DOE emailed WOKV to say the Education Commissioner will now determine if there is enough information to take away Bacca's teaching certificate.

As of this past Tuesday, Bacca is currently being held in the Duval County jail without bail.

According to a JSO report, he showered with a boy more than once while the victim spent the night at Bacca’s home, more than once.

The boy told police Bacca touched his private parts and performed oral sex on him more than once, according to the report.
