Jacksonville, FL —

The man who killed Makia Coney has lost his battle to get out of prison.

Charles Southern is serving a life sentence for killing his 17-year-old University Christian classmate in 2010.

Our partner Action News learned that Florida's 1st District Court of Appeals denied on Tuesday Southern's request for a sentence reduction.

His motion was based on a U.S. Supreme Court
ruling last year that life-without-parole sentences for children 17 and under were unconstitutional. The State Attorney's Office says that ruling was not retroactive and would not apply to Southern's sentence.

The attorney representing Southern tells Action News they will file a new motion with Florida's Supreme Court. They have 60 days to file.
