Jacksonville's Sheriff questions overturned murder conviction

Jacksonville, FL —

Jacksonville’s Sheriff is casting doubt on the State Supreme Court’s decision to overturn a local murder conviction.

In a statement released today, Sheriff John Rutherford says he is reviewing the interrogation of Randall T. Deviney now, but “at this time, I don’t believe the State Supreme Court for this one right.”

Deviney was convicted of first degree murder of Delores Futrell in 2010.  He was sentenced to death for the crime. Futrell was found stabbed to death in her home in 2008.

The Court ruled police coerced a confession from Deviney, and that confession is now out.

Rutherford is speaking now with State Attorney Angela Corey to decide how to move forward. He says they are considering an appeal.
