Orders prepared for Cristian Fernandez

JACKSONVILLE, Fla. —

It's a lot of back and forth between public defenders and the state attorney's office in the murder case of 12-year-old Cristian Fernandez.

 Prosecutors want the grand jury to bring new charges to Fernandez and are continuing to move forward on plea negotiations. State Attorney Angela Corey told WOKV that prosecutors have filed a proposed order to the judge.  But public defenders are trying to prevent it from happening.

“We’re just asking to be allowed to do our jobs basically which is what we intended to do when we were going to go the grand jury last Thursday,” says Corey.

Corey says a judge's ruling is expected soon in a separate case for Fernandez involving what she calls "non-homicide" and involves a 5-year-old victim.

“They are not charges relating to the murder of 2-year-old David. They do involve another child victim and they will be for charges that involve a life offense,” says Corey.

Fernandez is accused of beating his 2-year-old half-brother to death back in March. His trial date is tentatively set for February 27.
