Jacksonville, FL —

A man is dead after a police involved shooting at a Southside nightclub early Sunday.

Police say 24-year-old Nicholas Underwood was shot by an off-duty officer after they say he refused to drop his 22 caliber revolver at Aqua Nightclub in the 1100 block of Beach Blvd.

Two off duty officers were working security at the nightclub when they received reports that Underwood was going to his car to get a gun.

“Officer Peterson approached the subject, confronted him, and repeatedly ordered him to stop, drop the gun and get on the ground. The suspect refused to comply with every one of Officer Peterson’s orders,” says Chief Tom Hackney with JSO.

Hackney says in fear of the hundreds in the parking lot at closing and for the officer's safety, Officer Michael Peterson fired five shots at Underwood and killed him.

Officer Peterson was placed on administrative leave. No one else was injured at the time of the shooting.

It is unclear right now as to why Underwood went to his car to get the gun. But police say altercations inside the club earlier that night could be a reason.

Police say Underwood does not have a prior arrest record in Jacksonville.
