JACKSONVILLE, Fla. —

JSO making an arrest of one of its own last night for soliciting prostitution after running a couple of carefully planned stings to catch the employee in the act.

"We don't tolerate this kind of behavior here.  We hear about something like this and we investigate.  We take action," said Undersheriff Duane Senterfitt.

Senterfitt says 8-year veteran Officer David Sumlin is in custody on charges of soliciting a prostitute while on duty. Senterfitt says JSO conducted two separate stings where they sent a known prostitute as a decoy to talk to Officer Sumlin after getting tips that he was involved with known Jacksonville prostitutes.

"She does say that they've never engaged in any sexual activity but there has been conversation about it."

JSO says on November 1, Officer Sumlin met with a decoy prostitute and discussed having sex but never started negotiating a price.  The second time they sent the decoy out, on Monday, she and Sumlin agreed to a price of $20 which was all JSO needed to book him.

"It was pretty apparent what he was doing but they never really sort of closed the deal.  He talked about sex acts and what he wanted to do but they really didn't talk about price," says Senterfitt.

Sumlin then told the prostitute he had to leave to respond to a call but would meet her again when he finished.  JSO pulled the decoy from the street and arrested Sumlin when he came into work Tuesday.

Update at 9:40am Wednesday from JSO public information office:  "David Sumlin has turned in a resignation letter to the Jacksonville Sheriff's Office.
