Michael Dunn of Brevard County is accused of killing 17 year-old Jordan Davis at a southside Gate gas station.

JACKSONVILLE, Fla. —

The father of one of the teenagers who was in the SUV when his friend was fatally shot at a Southside gas station says the accused murderer is lying when he says he saw a gun.

Steven Stanislaus says his son was with three other teenagers when Michael Dunn, 45, fired eight or nine shots into the vehicle and killed 17 year-old Jordan Davis.

Stanislaus says the teens left his house before going directly to the Gate Gas Station at Southside Blvd. and Baymeadows Rd.

“So I know there was no gun in that car,” he said.

Dunn's Attorney Robin Lemonidis told reporters that Dunn heard the teenagers yelling multiple death threats and saw a shotgun barrel coming out of the SUV.  She says Dunn felt threatened and believed that the four teenagers could be gang members who were calling their friends to have him killed.  She claims Dunn fled and didn’t report the shooting because he was only trying to scare them.

Stanislaus tells WOKV that his son gave him a very different account of how it happened.

According to his son, when Dunn first approached the teenagers’ SUV he said, “Lower the damn music down, I can’t think.”

Lemonidis has said that Dunn asked them politely, “Would you mind turning that down?”

Stanislaus says his son turned the music down.  After that, Jordan Davis said, “Turn up the music and f**k him.”

That was the extent of the words exchanged before Dunn fired on the SUV, according to Stanislaus’ son.

“That doesn’t give you the right to kill somebody,” Stanislaus said.  “And it’s a shame to know we’re looking at a seventeen year old kid…has not lived any life just because somebody want to kill him over music.  It is over music.”

Stanislaus says his son asks him every day what he did to deserve what happened.  He said he tells his son he did nothing to deserve it.

“And I told him, ‘Son, this is just how the way the world is.  Some people you gotta stay away from.  I’m glad you lowered the music down.’ But that didn’t stop anything because three bullets still went in his door, it just never hit him.”

He says Lemonidis needs to “stop ruining these kids’ lives” by making them feel like they did something wrong when they didn’t.

“I understand she’s doing her job,” he said.  “Now I’m doing my job as a parent.  You’re going to say there was a gun, and I’m gonna tell her there was no gun.”

Stanislaus believes Dunn committed the murder either because of the music or he hated the teens.

“What’s the reason?” he asked.

Lemonidis said that when all the evidence has been flushed out, she believes it will be “extremely clear” that Dunn acted “as any responsible firearm owner would have under the same circumstances.”

Michael Dunn is being held without bond and his arraignment is scheduled for December 19th.  He is charged with second-degree murder and attempted murder.
