Marissa Alexander to stay in jail for now

A Florida appeals court is ordering a new trial for a woman sentenced to 20 years to prison after she fired a warning shot in a wall during a dispute with her husband.

Marissa Alexander will stay in jail, at least until January.

At a Wednesday bond hearing at the Duval County Courthouse, the judge said he is withholding his decision on whether to give Alexander bond, but he will make that decision before a January pre-trial hearing.

Alexander had been convicted and was sentenced to 20 years in jail for firing what she called a warning shot in the direction of her husband and two stepchildren, but that conviction was overturned because of improper jury instructions.
