Jacksonville, FL — A Nassau County Sheriff's Office deputy accused of multiple counts of perjury and one count of falsifying a police report, has now pleaded guilty.
As part of his guilty plea, Deputy Kyle Tholl will spend no time behind bars. Instead, he's been sentenced to 1 day time served and probation. In addition, he will be required to complete 100 hours of community service and pay restitution to one his victims. Tholl also agreed to give up his law enforcement certificate.
This after Tholl was accused of failing to field-test drugs found during at least four traffic stops or verify if the drugs were legally prescribed. Investigators say this failure to test drugs or accurately verify what they were, ended with victims arrested and charged, including one who spent nearly two months in jail.
The affidavit for arrest warrant says the accusations began on October 10, 2017, and continued through November 14, 2017.
The affidavit shows at least two victims were arrested during traffic stops for possessing a controlled substance, despite having a lawful prescription for the medication.
Another victim was said to have been arrested for pills that Tholl claimed tested positive for the presence of MDMA. Investigators say when they tested the same pills, the results found the drugs were actually Aspirin.
The court documents show when investigators when through in-car videos of Tholl, he did not actually field test drugs on multiple occasions, despite claiming he did.
Tholl was initially arrested and bonded out of jail on May 30, 2018.
