WOKV legal anaylst Mark Rubin says Stand Your Ground is not going to hold up in the case of a Tampa movie theater shooting over a text message.
"The person who was the perpetrator has to be in a position where they are in fear for their life."
Rubin says in his opinion, the facts dont seem to reveal the 71-year-old retired Tampa police officer Curtis Reeves Jr, was in fear for his life.
"There's no allegation here that the victim had a weapon."
Right now, it appears the primary facts indicate he was agitated by text messaging during a movie.
43-year-old Chad Oulson was shot and later died at the hospital. Reeves is charged with second-degree murder and being held without bond.
Rubin believes Stand Your Ground will not hold up as a defense. He says the interesting part will be hearing eyewitness accounts from those inside of the movie theater. However, he contends the judge and court have a way of deciphering what's truth and what's not.
