Florida again considers ban on smoking with kids in car

A law just proposed in Florida would make it illegal for people to smoke cigarettes when kids are in the car.

Sen. Jeff Clemens, D-Lake Worth, filed the bill (SB 548) Wednesday which would prohibit people from smoking in vehicles when children under age 13 are present.  Drivers would receive a non-moving violation.

"Children can't really defend themselves," says State Representative Charles McBurney, who filed a similar bill last year.  "We looked at the impact of that on children, which was actually quite significant."

The bill will be considered during the legislative session beginning March 3.
