The attorney for Marissa Alexander, who is awaiting retrial after firing what she calls a warning shot at her husband, says he may file a motion by Friday concerning Stand Your Ground.
Previous attempts at using that defense were rejected by a judge.
A Florida appeals court ordered new trial for Alexander, who was sentenced to 20 years in prison. The 1st District Court of Appeal ruled that a judge did not properly instruct the jury handling the case.
Alexander claimed her husband was abusive and threatened her during a dispute in 2010. She claimed she fired a gun in a wall near her husband and her two stepchildren as a warning.
A jury previously convicted Alexander on three counts of aggravated assault with a deadly weapon.
