A psychologist who evaluated Cristian Fernandez says it appears that the 13-year-old didn't understand his Miranda rights at the time of his two police interrogations.
Dr. William Meadows says he also found that Cristian was a straight-A student at Kernan Middle School at the time of the death of his two-year-old half-brother.  His IQ test showed he has an IQ of 99, which is average.  Meadows did say, however, that Cristian shows classic signs of depressive disorder and attention defecit hyperactivity disorder.
A motions hearing that could go on for three days gets underway Thursday morning.
